These are template terms reflecting common practice for an Indian tour operator. The cancellation percentages and liability wording in particular carry real legal and financial consequences — have a lawyer review and adjust them to how you actually trade before going live.
Agreement
These terms apply when you browse paryatan.com, create an account, or book any package or service through us. By making a booking you confirm that you have read and accept them, and that you are at least 18 and able to enter a contract.
If you are booking for other travellers, you confirm you have their authority to accept these terms on their behalf.
What we are
For packages sold under our own name, Paryatan is the tour operator and is responsible for arranging the services described in the itinerary.
For flights, trains, buses and hotels, we act as an intermediary and direct you to third-party booking platforms. Those bookings are governed by that provider's terms, and the contract for those services is between you and them.
Prices and inclusions
Package prices are quoted per person on a twin-sharing basis in Indian Rupees unless the package says otherwise. The inclusions and exclusions listed on each package page form part of your contract — please read them, particularly the exclusions.
Prices are subject to change until your booking is confirmed. Once confirmed, we will not increase the price except where government taxes or fees change, or where you amend the booking.
Rates for peak season, long weekends and festival periods may differ from the price displayed. Any such difference will be confirmed to you before payment.
Booking and payment
Submitting the "Book Now" form on this website is a request for a callback, not a booking. It creates no obligation on either side and takes no money. A booking is confirmed only when we have issued a written confirmation and received the payment due. Until then, availability and price are not guaranteed.
No payment is collected on this website. Our travel team arranges payment with you directly after the callback. You are responsible for making sure the traveller names you provide match the government photo ID that will be presented at check-in and at any permit checkpoint.
Cancellation and refunds
Cancellation charges are calculated from the date we receive your written cancellation request, as a percentage of the total package cost:
- 30 days or more before departure — 10% of package cost
- 29 to 15 days before departure — 25% of package cost
- 14 to 8 days before departure — 50% of package cost
- 7 days or fewer before departure, or no-show — 100% of package cost
Refunds in practice
Approved refunds are returned to the original payment method, normally within 7 to 14 working days of approval.
Some components are non-refundable regardless of notice period, because we cannot recover them ourselves. These include confirmed air tickets, train tickets, permits, and peak-season hotel and houseboat deposits. Where this applies, we will tell you the non-refundable amount before you pay.
Specific packages may carry different cancellation terms, which are stated on the package page and take precedence over the schedule above.
Changes by us
Itineraries can change for reasons outside our control — weather, road or pass closures, permit decisions, or supplier failure. Where this happens we will offer the nearest equivalent arrangement at no extra cost.
If we have to make a significant change before departure and you do not accept the alternative, you may cancel and receive a refund of amounts we can recover, less any non-refundable components already committed.
Force majeure
We are not liable for failure to perform where that failure results from events beyond our reasonable control, including natural disaster, extreme weather, landslide, epidemic, act of government, civil unrest, strike or closure of a route or region by the authorities.
In these situations we will pass on any refunds we are able to recover from suppliers, but we cannot guarantee a full refund of amounts already paid out on your behalf.
Your responsibilities
Before and during travel, you are responsible for:
- Carrying valid government photo ID, and any permit or clearance we tell you is required
- Assessing whether an itinerary suits your fitness and health — several of our routes involve high altitude, long drives and unavoidable walking
- Arranging your own travel insurance, which we strongly recommend for every trip
- Arriving at the stated times; we cannot recover the cost of services missed because of late arrival
- The cost of any damage caused to accommodation or vehicles
High-altitude and adventure travel
Packages covering Ladakh, Auli, Char Dham, Valley of Flowers and similar routes involve altitude, remote roads and limited medical facilities. Acclimatisation days are built in where relevant, but altitude sickness can affect anyone.
If you have a cardiac, respiratory or other relevant condition, obtain medical advice before booking and tell us at the time of booking.
Liability
We accept responsibility for arranging the services described in your itinerary with reasonable skill and care. We are not liable for loss or damage caused by a third-party supplier acting outside our control, nor for indirect or consequential loss.
Nothing in these terms limits liability for death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded.
Complaints
If something goes wrong during your trip, tell your travel manager or local representative immediately so we have the chance to fix it. Problems raised on the spot can usually be resolved; those raised weeks later often cannot.
If it remains unresolved, write to us within 30 days of returning and we will respond within 15 working days.
Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
